Information We Collect
We may collect a variety of information from or about you or your devices from various sources, as described below.
A. Information You Provide to Us.
Registration, Profile, and Other Information You Provide. When you register to use our Services, we ask you for your email address, username, and password. If you sign up using a social media account, we will also receive information from those social media services such as your name, email address, gender, date of birth, profile photo, and friends. You may choose to provide us with further information while using our Services, including but not limited to food you consume, your weight, feedback and response to recommended dishes, menus, recipes, packaged foods, and restaurant meals.
Primary care physician. To use our Services, you are required to provide your primary care physician’s name and contact information, and consent to let us contact your primary care physician on your behalf to transmit prescription information or in case abnormal blood glucose readings are detected during use of the January app.
Heart rate monitor readings. Our services rely on data from your heart rate monitor device (eg FitBit and Apple Watch) that you connect to our systems. Your device collects data to estimate a variety of metrics like the number of steps you take, your distance traveled, heart rate, sleep stages, active minutes, and location. The data collected varies depending on which device you use. When your device syncs with our applications or software, data recorded on your device is transferred from your device to our servers.
Wellness Recommendations. We do not intend to provide any diagnosis, treatment, or medical advice, and should not be used, relied upon, or replace any medical advice. You should always consult with a medical professional before you start or make changes to your diet and/or exercise routine. If you have a medical/health condition or if you have any medical questions, please consult with your doctor.
Dosing decisions should not be made based on the January app or its Services. The user should follow instructions on the continuous glucose monitoring system as prescribed by his/her doctor.
The January app is not intended to replace self-monitoring practices as advised by a physician.
Communications. If you contact us directly, we may receive additional information about you. For example, when you contact our Customer Support Team, we will receive your request, name, and email address.
B. Information We Collect When You Use Our Services.
Location Information. When you use our Services, we collect your location information, including general location information (e.g. IP address, city/state and/or zip code associated with an IP address) from your computer or mobile device. If you access the Services through a mobile device, we may ask your permission to collect your precise geo-location information. We use your location information for purposes such as making recommendations for nearby services. If you do not wish to have us collect specific geo-location information, you may disable the location features on your device. For more information regarding location services, please contact your device manufacturer or mobile carrier. Turning off location services may impact certain features of the Services.
Device Information. We receive information about the device and software you use to access our Services, including internet protocol (IP) address, web browser type, operating system version, application installations, device identifiers, mobile advertising identifiers, and push notification tokens.
Usage Information. To help us understand how you use our Services and to help us improve them, we automatically receive information about your interactions with our Services, like the website you visited before our Services, the number of clicks, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time you used the Services and upload or post content, error logs, and other similar information.
Information from Cookies and Similar Technologies. We and third party partners collect information using cookies, pixel tags, or similar technologies. Our third party partners, such as analytics and advertising partners, may use these technologies to collect information about your online activities over time and across different services. Cookies are small text files containing a string of alphanumeric characters. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to our Services. Please review your web browser’s “Help” file to learn the proper way to modify your cookie settings. Please note that if you delete or choose not to accept cookies from the Service, you may not be able to utilize the features of the Service to their fullest potential.
C. Information We Receive from Third Parties.
Information from third party services. If you choose to link our Services to a third party account, we may receive information about you, including your health and wellness data, or your contacts. If you wish to limit the information available to us, you should visit the privacy settings of your third party accounts to learn about your options.
Other third parties. We may receive additional information about you from third parties such as data or marketing partners and combine it with other information we have about you.
How We Use the Information We Collect
We use the information we collect:
- To provide, maintain, improve, and enhance our Services;
- To personalize your experience on our Services such as by providing tailored content and recommendations;
- To understand and analyze how you use our Services and develop new products, services, features, and functionality;
- To communicate with you, provide you with updates and other information relating to our Services, your account, provide
- information that you request, respond to comments and questions, and otherwise provide customer support;
- To facilitate the connection of third party services or applications, such as social networks;
- For marketing and advertising purposes, such as developing and providing promotional and advertising materials that may be useful, relevant, valuable or otherwise of interest to you;
- To process and deliver program;
- To ask you to complete surveys about the Services or programs;
- To aggregate and/or remove identifying data elements from your information for marketing, and to prepare analyses or reports for our partners, or potential partners regarding the use of our Services and/or data about our user population. These analyses or reports may relate to our partners’ digital health products and services, including population health, or other disease management programs;
- To send you text messages and push notifications;
- To find and prevent fraud, and respond to trust and safety issues that may arise;
- For compliance purposes, including enforcing our Terms of Service or other legal rights, or as may be required by applicable laws and regulations or requested by any judicial process or governmental agency; and
- For other purposes for which we provide specific notice at the time the information is collected.
How We Share the Information We Collect
Vendors and Service Providers. We may share any information we receive with vendors and service providers retained in connection with the provision of our Services.
Third Party App Integrations. If you connect a third party application to our Services, we may share information such as logon name, with that third party.
Analytics Partners. We use analytics services such as Google Analytics to collect and process certain analytics data. These services may also collect information about your use of other websites, apps, and online resources. You can learn about Google’s practices by going to https://www.google.com/policies/privacy/partners/, and opt-out of them by downloading the Google Analytics opt-out browser add-on, available at https://tools.google.com/dlpage/gaoptout.
Each operating system, iOS for Apple phones, Android for Android devices and Windows for Microsoft devices provides its own instructions on how to prevent the delivery of tailored in-application advertisements. We do not control how the applicable platform operator allows you to control receiving personalized in-application advertisements; thus, you should contact the platform provider for further details on opting out of tailored in-application advertisements. You may review the support materials and/or the device settings for the respective operating systems to opt-out of tailored in-app advertisements.
As Required By Law and Similar Disclosures. We may access, preserve, and disclose your information if we believe doing so is required or appropriate to: (a) comply with law enforcement requests and legal process, such as a court order or subpoena; (b) respond to your requests; or (c) protect your, our, or others’ rights, property, or safety. For the avoidance of doubt, the disclosure of your information may occur if you post any objectionable content on or through the Services.
Consent. We may also disclose your information with your permission.
Account Information. You may modify your account information by accessing the Settings area of your account.
Location Information. You can prevent your device from sharing precise location information at any time through your device’s operating system settings.
Communications. You can unsubscribe from our promotional emails via the link provided in the emails or via the Settings in your account. You may opt-out of receiving text messages from us by replying to a text from us with the words “STOP”, “QUIT”, or “UNSUBSCRIBE.”
If you choose not to provide us with information we collect, some features of our Services may not work as intended.
We make reasonable efforts to protect your information by using physical and electronic safeguards designed to improve the security of the information we maintain. However, as our Services are hosted electronically, we can make no guarantees as to the security or privacy of your information.
International Transfers of Data
Our Services are hosted in the United States and intended for visitors located within the United States. If you choose to use the Services from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your personal information outside of those regions to the United States for storage and processing. Also, we may transfer your data from the U.S. to other countries or regions in connection with storage and processing of data, fulfilling your requests, and operating the Services. By providing any information, including personal information, on or to the Services, you consent to such transfer, storage, and processing.
